I don't even know what you mean when you say "the global patent system." Are you talking about the Patent Cooperation Treaty, or perhaps about the various national patent offices? I think the european patent system is better in a lot of ways than the US patent system, but most of the major differences come down to policy choices.

At least in the way patents are delivered. In many countries software patents are illegal yet they're granted every day.
