The premise is standard boiler-plate from the TOS. The possibility that others would delete my comments arises from the way the "delete account" option is worded. I haven't actually experimented with how this mechanism works, but if my comments are associated with the claim they pertain to, they might well be deleted at the same time.
That's a problem for me. I acknowledge that users have the right to disassociate themselves from the site, and that deleting their claims is an integral part of this. But good comments are work, and I object to the idea that some jackass griefer can kill them at his whim. Further, it's at odds with my rights as the owner of the comments. Some thinking should go into how to address both needs.

If you want to preserve your comments for all eternity, it's your responsibility to do so. When you post a comment on someone else's claim, you're essentially contributing your wisdom (or lack thereof) to that claim. Without the claim, your comments don't have context, so there's no reason Jyte should keep them around if the claimant deletes their account.
I understand why you don't want to lose that context (even though I don't agree with you - I think that it's a reasonable desire, but I think that every social networking site needs a way to opt out, regardless of whether a user opted in in the past) - but I don't think that this is the right angle. Nobody takes away your ownership of your content when they stop publishing a copy of it.
