7. Who Owns User-Developed Content and Can You Delete It:
...you do not actually own the user-driven content on your site. Instead, it is actually the copyrighted property of the author...The fact that you do not own the user-driven content on your site can create a number of headaches for bloggers, such as an obligation to remove a comment whenever the author requests...

Unless their terms of service says otherwise.
By displaying or publishing ("posting") any Content on or through the Services, you hereby grant to Jyte.com a limited non-exclusive license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the Services.
For instance. Before anyone gets up in arms about jyte's policy here, read the ToS yourself, and be sure to notice that
This license will terminate at the time you remove your Content from the Services. The license does not grant Jyte.com the right to sell your Content, nor does the license grant Jyte.com the right to distribute your Content outside of the Services.
So in this particular instance, no, jyte is not required to delete your comments or claims, unless you decide to delete all the information you've put on jyte.
Um, yeah! What he said, baby. How you like that, law dog?*
* In the interest avoiding another incident of all the tension about attitude lately, I feel it is necessary to point out that I, the party of the first part, am attempting to be humorous in a funny way. There is no assurance of funniness inherent in the attempt. Past performance does not guarantee future results. Your individual results may vary. Harmful side-effects include but are not limited to: ingrown toenails, colitis, dropsy, painful rectal itch, priaprism, explosive diarrhea, and highly focused laser-like diarrhea. This offer not valid to residents of Utah or employees of the Microsoft Corporation or their immediate families. By reading this entire comment you agree to give someone else on Jyte the cred they deserve but which you've been putting off until your "cred catch up day."
@zeb, that request to delete all of the information you've put on Jyte was sort of what I was referring to in the first place.
Note this claim was inspired by a comment about "delete account" button being too scary.
In fact the second paragraph from the terms of service specifically mentions "This license will terminate at the time you remove your Content from the Services." so I guess I don't understand the basis for your disagreement.
It would be just as easy for jyte's ToS to not include that second paragraph. I'm glad it's there, but they aren't obligated to offer to remove one's content on request.
Okay - I think I'd disagree with my own claim at this point from further reading.
However I don't think it would be sufficient to remove the verbage from the terms of service. By default you are obligated to remove the user's copyrighted material. What Jyte would need to do is include something in the terms of service that specifically states by posting content you are granting Jyte license to display that content, and that by that license they are *not* obligated to modify or remove the content on request.
So the claim should read "A site is obligated to delete user-developed content on their request, unless the terms of service specifically state otherwise."
Right, I think we're on the same page here.
